The Website is owned, maintained and published and maintained by TSC INDIA Limited

This User Agreement along with Terms of Service “User Agreement” defines the terms and conditions for the use of services and products of TSC INDIA Limited (“TSC”).

The Website is meant to be used by bonafide User(s) for a lawful use. When you access, browse or use this Site you accept, without limitation or qualification, the terms and conditions set forth. The same terms and conditions also apply purchases of any products or services of TSC through its Sales Channels (websites, mobile applications, sales persons, offices, call centres, branch offices, franchisees, agents etc.

TSC reserves the right, in its sole discretion, to terminate the access to the Website and the services offered without notice on the same or any portion thereof at any time. Both User and TSC are individually referred to as “Party” and collectively referred to as “Parties” to the User Agreement.

Who is ELIGIBILE to use?

The User must be at least 18 years of age. All users must have the legal authority to enter into an agreement to become a User and use the services of TSC. Minors below the age of 18 Years of age shall not register as a User of the Website.

It is mandatory that before using the Website or approaching any “Sales Channels” ( as listed above) , the Users must compulsorily read and understand this User Agreement. AND all users shall be deemed to have accepted this User Agreement as a binding document for transactions with TSC. In case of disagreement the User must not avail TSC”s services or access or approach the “Sales Channels” of TSC.

CONTENT

All content provided in the Website and its Sales Channels, including but not limited to “content”: text, messages, audio, images, proprietary logos, service marks and trademarks etc are registered by TSC. The “Content” is protected under applicable intellectual property laws. The use of this content is not allowed for any other purpose, except as specified herein.

In pursuance of respecting intellectual property rights of others and in case you notice any act of infringement on the Website, TSC requests you to send us a written notice/ intimation which includes information as;

1. Clear identification of copyrighted of work that has been infringed and its location on the Website or its “Sales Channels”
2. Clear proof of ownership that the alleged copyrighted work. Such information can be shared via an email at support@tscpl.biz.

WEBSITE

TSC will always ensure that the content on its websites or other sales channels are free of any virus or malwares. In case any data or information downloaded or otherwise obtained through the use of the Website or its Sales Channel is done entirely at the User”s own discretion and risk. In all such cases User will be solely responsible for any damage ( computer systems, data loss etc).User shall not distribute exchange, modify, sell or transmit anything from the Website, including but not limited to any text, images, audio and video, for any business, commercial or public purpose.

To access the Website may only be available to registered User(s). The process of registration requires the User to answer certain questions or provide certain professional / personal information. Such fields can be optional or mandatory. User warrants accuracy and truthfulness of the information supplied to TSC.

User shall not do any of the following:

1. Defame, abuse, harass, stalk, threaten or otherwise violate the legal privacy rights of others which includes post or publish obscene, indecent or unlawful material or information
2. Upload or attach files that contain viruses, corrupted files or any other similar software or programs that may damage the operation of the Website.
3. Upload or attach non owned files that contain software or other material protected by intellectual property laws (or by rights of privacy and publicity)

TSC reserves the right to periodically make improvements or changes in its Website at any time without any prior notice to the User

BOOKINGS BY TRAVEL AGENTS / USERS

1. Due payment collection period will be notified by TSC from time to time. The payment for the services availed can be made by cash/cheque/demand draft/credit card.
2. In case of non-payment within 7 days of the due date you, the Notices, shall be liable to pay interest at the rate of 0.1% per day till the date of payment of the full amount.
3. No adjustments of refunds will be allowed in due payments and the said refunds shall be paid back to the agent whenever the Airline.
4. (a) Voiding – as per the Airline norms plus Service Charge per ticket. (Will be entertained only till 1800 Hrs).

(b) Refund – as per the Airline norms plus Service Charge per ticket.

1. TSC reserves the right to charge certain fees in the nature of convenience fees or service fees. TSC further reserves the right to alter any and all fees from time to time. Any such additional fees, including fee towards any modifications thereof, will be displayed to the User before confirming the booking or collecting the payment from such User.
2. Non-payment or delayed payment will authorize TSC to cancel all the PNR’s/Tickets without any prior notice.
3. Any kind of Misuse of Airline/GDS PNR will solely be the responsibility of the agent and the ADM (Airline or GDS) amount will be recovered from the agent.
4. TDS will be deducted as per the existing law on all commissions/incentives and certificate will be issued in the next Financial Year.
5. The User shall request TSC for any refunds against the unutilized (full or partial ) or “no show” of booking on all products purchased from TSC and all unclaimed amounts for such unutilized or no show of all such booking shall be deemed to have been forfeited.
6. It is Agents responsibility to maintain all related documents to the bookings made for travel within or outside India.
7. OBLIGATION TO OBTAIN VISA: International bookings made through TSC are subject to the requirements of visa (visitor / transit visa, OK TO BOARD which are to be obtained by the User. TSC is not responsible for any issues, including inability to travel, arising out of such visa requirements and is also not liable to refund any amount to the User who are not able to utilize the booking due to any Visa related issues.
8. The User will not share his personal sensitive information like credit/debit card number, CVV, OTP, card expiry date, user IDs, passwords etc. with any person including the agents, employees or representatives of TSC. The User shall immediately inform TSC if such details are demanded by any of its agents” employees or representatives. TSC shall not be liable for any loss that the User incurs for sharing the aforesaid details.
9. TSC holds the right to deposit the security cheque collected at the time of registration in case of breach of payments by the said agent as per BSP cycle stated by IATA. The agent under no circumstances should hold TSC INDIA Limited liable to this process.
10. In case of import PNR’s any system abuse or ADM’s raised by airlines shall be borne by the agent only and under no circumstances TSC would be held liable for the same. TSC holds the rights to cancel PNR’s and recover the same in case of breach of trust and payments not being done by the agent.
11. The agent shall be responsible for issuance of one way or return tickets as per Airline policies stated by the airlines and under no circumstances hold TSC liable for the same in the court of law. This will be the sole responsibility of the agent to check the tickets issued by TSC as per the agents stated requirements and clarify the same as per airline ticketing rules and policies at their end. It is the sole responsibility of the agent to make sure that the tickets are issued as per the visa held by the passenger, and it is in line with the airline policy.

Refund Policy

Refunds of all airline tickets shall be processed as per the airline policy. Refund shall me made through original form of payment. The amount shall be paid as per airline cancellation charges plus RAF (INR354) Plus our service charges of INR 100 Plus K3(GST 5% on Economy class OR GST 12% on Premium Economy/Business/First class) on airline cancellation charges.

USER”S RESPONSIBILITY

All users are advised to check the description details of the services and products carefully before making a booking. User(s) agree to be bound by all the laid out conditions in the bookings and User Agreement.

In case a User is making a booking on behalf of another person, it is the user’s responsibility to inform such person about the terms of this Agreement, including all rules and restrictions applicable.

The User undertakes to abide by all dynamic procedures and guidelines in connection with the use of the services available through TSC.

The User undertakes to comply with all applicable laws (Central Government, State Government, District Authorities or any other statutory body empowered to do so), regulations, orders, and directions etc. for use of services/transactions of/with TSC.

USE OF USER’S MOBILE NUMBER, COMMUNICATION DETAILS BY TSC

TSC will send booking confirmation, itinerary information, cancellation, payment confirmation, refund status, schedule change or any such other information relevant for the transaction or booking made by the User, via SMS, internet-based messaging applications like WhatsApp, voice call, e-mail or any other alternate communication detail provided by the User at the time of booking.

TSC may also contact the User through the modes mentioned above for any pending or failed bookings, to know the preference of the User for concluding the booking and also to help the User for the same.

The User hereby unconditionally consents that such communications via SMS, internet-based messaging applications like WhatsApp, voice call, email or any other mode by TSC are:

LRS COMPLIANCE (LIBERALIZED REMITTANCE SCHEME) AND TCS

The RBI mandates collection of PAN details for all transactions made under Liberalized Remittance Scheme (LRS) which include any international booking made on the Website or through Sales Channels. The User warrants and confirms that PAN details of the User/traveller will be shared by the User on or before the cut-off date prescribed by TSC either at the time of booking or after the booking is made

The User authorizes TSC to share User/traveller data with third party (ies) for collecting or verifying PAN details of User/traveller. It shall be the responsibility of the agent to deposit TCS wherever applicable and the agent must provide an undertaking in this regard. In case the agent fails to deposit the TCS wherever applicable then TSC reserves the right to collect the amount of the TCS from the agent along with applicable interest and any penalty, if any. The agent must produce copy of the PAN of traveller for any hotel booking or holiday package booked through TSC.

FAKE CALLS OR FRAUDULENT ACTIVITIES

1. TSC’s employees or authorized representatives will never contact a User asking for his/ her credit or debit card number, expiry date, CVV, net banking login, passwords, OTP etc.
2. TSC will never request for a fund transfer to a personal or an individual bank account.

Acting on any of these requests may make you a victim of fraud, and may potentially lead to loss of your valuable money or information, please report it immediately on support@tscpl.biz.

INDEMNIFICATION

The User agrees to indemnify TSC, its affiliates and their respective officers, directors, lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by such indemnified persons, that arise out of, result from, or may be payable by virtue of, any breach of any representation or warranty provided by the User, or non-performance of any covenant by the User.

The User shall be solely liable for any breach of any country specific rules and regulations or general code of conduct and TSC cannot be held responsible for the same.

These terms and conditions are governed by and shall be construed in accordance with the laws of the Republic of India and any dispute shall exclusively be subject to the jurisdiction of the appropriate Courts situated at Jalandhar, Punjab, India.
